UBS此前已有前科。2018年,该行因2004年至2017年间未妥善审查外国银行代理账户,被罚1450万美元,并被要求改进反洗钱监控系统。然而,FinCEN认定其整改耗时过长,期间未能对超过5万笔、总额逾100亿美元的电汇进行适当审查。据瑞士媒体报道,UBS此后投入约3亿美元用于系统升级,相关改进现已完成。
此次罚款将由FinCEN、SEC、商品期货交易委员会(CFTC)及金融机构监管署(FIRA)共同分配。UBS表示已全面配合调查,并投入大量资源以弥补缺陷。该行同时需聘请第三方机构,对可能遗漏的可疑交易进行回溯审查,并接受对其反洗钱体系的独立评估。
此案恰逢UBS在美国市场谋求战略转型之际。该行已于今年3月获准从财富管理机构向全能银行演进,计划在2027年底前向美国客户提供支付、储蓄及私人账户服务。分析人士认为,此次罚款虽金额可观,但作为历史遗留问题,其了结有助于UBS为在美业务扩张扫清监管障碍。
